Chief Resident Magistrate Madalitso Chimwaza has overruled the objection raised by the State on Wednesday in regard to the kind of questions the defence side is supposed to be asking the state witness in the extradition case involving Shepherd Bushiri and his wife Mary.
Chimwaza, among others, said extradition proceedings are different from ordinary criminal proceedings as the court is supposed to receive enough evidence for determination.
When the court met on Wednesday, the State raised an objection that the defence team was asking questions which are not supposed to be asked at this stage of the extradition case.
South Africa is fighting in Malawi’s courts to extradite the Bushiris back to that country so that they answer various charges back in that country.
Meanwhile, the case has been adjourned to Friday morning.
