The High Court Division in Lilongwe has adjourned the hearing of the case between Government and SF International to 18th December this year.
In the case, the Malawi Government continues to challenge a $6 million claim by Shiraz Ferreira, owner of SF International Company, which between 2012 and 2013 was awarded a $30 million contract to supply goods to the Malawi Defence Force.
The adjournment comes after Attorney General, Thabo Chakaka Nyirenda, finished cross examining a witness of the claimant on Tuesday.
Nyirenda argued that in actual sense, the claimant was over paid hence the government’s demand of $2. 5 million refund from SF International.
He said this is based on the fact that the company did not supply all goods, as stipulated in the contract.
The claimant’s lawyer, Shabir Khan, said when the case hearing resumes on the 18th, SF International’s owner, Shriza Ferreira, who is the case’s final witness, will be cross-examined by the state.
Following Ferreira’s testimony, the state will present three witnesses in court.
