The claimant was overpaid — AG

The Malawi Government continues to challenge a $6 million claim by Shiraz Ferreira, owner of SF International Company, which between 2012 and 2013 was awarded a $30 million contract to supply goods to the Malawi Defence Force.

Attorney General (AG) Thabo Chakaka Nyirenda, said he was able to demonstrate that Ferreira got all the payments and the claim to receive interest for delayed payment is baseless.

Nyirenda said this in Lilongwe on Tuesday when he was in court, cross-examining a witness from the claimant.

He argued that in actual sense, the claimant was over paid hence the government’s demand of $2. 5 million refund from SF International. He said this is based on the fact that the company did not supply all goods, as stipulated in the contract.

This afternoon, the AG will continue cross examining James Lindani, an accountant from SF International. Justice Chifundo Kachale is hearing the case at the Commercial Court Division in Lilongwe.
