Life in prison for killing child with albinism

In an apparent bid to deal with the killings of people with albinism, a High Court of Malawi sitting in Phalombe has on Friday sentenced Humphrey Eliya to life imprisonment and Marry Nankhuku to 25 years imprisonment with Hard Labour for killing their 12 year old child born with albinism, Joseph Kachingwe.

Kachingwe went missing on 6th July last year when he went for independence celebrations with his friends in the area of traditional authority Jenala in the district.


The two who pleaded not guilty were later found guilty of murder which is contrary to section 209 of the penal code after the state had paraded four witnesses who testified against them.


In his judgement on 26th day of last month, High Court Judge Justice Sylvester Kalembera said having going through the evidence presented by the State, the court was convinced that the two were involved in the killing of Kachingwe.


He said Eliya admitted that he know some of the remaining suspects and that mother of the deceased said she agreed that the boy should be sold and that the former had been heard for several times saying he was keeping millions of money in his house meaning Kachingwe.


Kalembera also said that second state witness told the court that he saw Eliya buying a bottle of frozy juice which was later infested with poison which killed the victim.

 
He added that looking at the way how people of albinism have had been killed in this country, Kachingwe could have faced the same fate.


In his sentence on Friday, Kalembera sentenced Eliya who was the step father to deceased to spend his rest of life behind bars and his wife Nankhuku who is the biological mother to Kachingwe to 25 years imprisonment with hard labour.


Eight people were arrested in connection with the case and the state applied that two convicts should have their case heard separately.


The other six whose case is under Judge Justice Maclean Kamwambe are identified as Patrick Chinawa, Eniphat Chinawa, Biton Tambwali, Steven Chauma, Julius Mkhwayi and Joseph Mankhokwe.
