Minibus driver sentenced to 1 year IHL for obstructing police officer

The Midima Senior Resident Magistrate Court has convicted and sentenced a 30 year old minibus driver to 12 months Imprisonment with Hard Labour – IHL for obstructing police officer in due execution of his duty contrary to section 256(b) of penal code.

According to Limbe Police Deputy Public Relations Officer, Pedzesayi Zembeneko said the officer name withheld filed a complaint against Frank Tchulani,a minibus driver saying he was pushed down and sustained multiple wounds on both arms and knees while trying to stop the Minibus. He further said when the officer was pushed down to the ground, Tchulani drove away to unknown destination.


“It happened when a team of traffic police officers was doing routine patrols in Limbe. The said minibus was spotted packed and picking passengers at unauthorized place, old bus depot. Upon seeing the police, the driver switched on the engine and drove away to unknown destination,” explained Zembeneko.


However, Zembeneko said the minibus was intercepted at a junction near Limbe police station due to traffic jam.


“Tchulani was charged with two counts: committing an act intended to cause grievous harm contrary to section 235(a) of the penal code and obstructing police officer in due execution of duty contrary to 256(b) of the penal code,” said Zembeneko.


The minibus driver pleaded guilty to the second count and has since slapped with 12 months of custodian sentence. The other count has been adjourned to 16 May, 2017.


During mitigation, Tchulani asked for fine option instead of custodian because he is a sole bread winner.


However, the Midima Senior Resident Magistrate Mangawa Makhalira quashed away the mitigation facts saying the offence was committed while running away from the fine.


Frank Tchulani hails from Motheliwa village Traditional Authority Changata,Thyolo.
