Kasambara and Kumwembes’ bails were revoked by High Court Judge Michael Mtambo on September 23, 2015 over what he claimed was an infringement on his private space by allegedly accessing his private information; making them to spend five and four months respectively on remand at Maula prison.
The two including businessperson Pika Manondo are defending themselves in the shooting case of former budget director Paul Mphwiyo at the gate of his Area 43 residence in Lilongwe on September 13 2013.
During the ruling on Wednesday, the Judge said the two deserved bail because the State prosecutors had then finished parading their witnesses and that they can no longer threaten witnesses.
They have however been warned against talking about the case to the media or publicly.
In a related development, former People’s Party (PP) Vice President Brown Mpinganjira testified in the case where he denied threatening Mphwiyo to issue payments.
Mpinganjira was mentioned during one of the court session to have used his powers to threaten Mphwiyo to issue the infamous cheques which led to the massive plundering of public recourses during the two year long PP regime.
Mphwiyo was shot outside the gate of his Area 43 residence in Lilongwe on September 13 2013, a shooting which is believed to have exposed the plunder of public resources at Capital Hill that came to be known as Cashgate.
Mphwiyo’s shooting on September 13, 2013 led to the revelations of massive looting of public funds at Capitol Hill dubbed cashgate.
